FACTS CONSIDERED

A man walked past another person and called them cute. The comment was unwanted and made the person uncomfortable.

RULING

The man performed the conduct. Rule 10.04 requires common sense when a dating-style comment affects someone. A personal remark to a stranger can create an avoidable uncomfortable moment. There was no agreement, emergency, or genuine need. The comment crossed the line, even though it was brief.

REMEDY

He should not repeat the comment. In future, he should keep unsolicited personal remarks to himself and continue walking with full conversational restraint.
